The legibility of the user’s handwriting will be determined by BLOXDUEL in its sole discretion. For the avoidance of any doubt, the requirement for the post card to be “handwritten” means that the user must personally hand write each entry and not use any stencil or copying device.
In the event of a dispute as to the identity of who submitted a request, or whether a request satisfied the requirements set out above, cannot be resolved to BLOXDUEL’s satisfaction, the affected request/entry will be deemed ineligible. BLOXDUEL is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Sweeps Cash requests or allocations.
BLOXDUEL reserves the right to reject requests made from the excluded territories.
6.10 PROMOTIONS
6.10.1. All promotions, including games played in Promotional Mode, contests, special offers and bonuses, are subject to these Terms and to additional terms that may be published at the time of the promotion.
6.10.2. In the event and to the extent of any conflict between these Terms and any promotion specific terms and conditions, the promotion specific terms and conditions will prevail.
6.10.3. BLOXDUEL reserves the right to terminate or cancel any promotional giveaway without prior notice, and without any liability to the user whatsoever.
6.10.4. BLOXDUEL reserves the right to withhold any Fun Cash, Sweeps Cash, or other token at its sole discretion and without any liability to you whatsoever.
6.10.5. BLOXDUEL reserves the right, at its sole discretion, to withdraw or modify any promotions on the website without prior notice to you and without any liability to you whatsoever.
6.10.6. If in the reasonable opinion of BLOXDUEL, we form the view that any user is abusing any promotion, to derive any advantage or gain for themselves or other user, including by way of fraudulent conduct as described in Section 10, we may, at our sole and absolute discretion, withhold, deny, or cancel any advantage, bonus, or prize as we see fit without any liability to you whatsoever.
6.10.7. 7. Prize Claim and Redemption
7.1. Prizes
7.1.1 Only play in Promotional Mode gives access to Prizes of value. No Prizes can be won through Standard Mode.
7.1.2. Only Sweeps Cash can be redeemed for Prizes.
7.1.3. All users are required to play their Sweeps Cash at least one time before they are eligible to be redeemed for Prizes.
7.1.4. BLOXDUEL reserves the right to change the Prize, win rates, and odds of any sweepstakes at any time and at our absolute discretion. It is a user’s responsibility to check the Prize win rate on each occasion before participating in any game.
7.2 Prize Redemption Methods
7.2.1. The Prizes for which you can redeem Sweeps Cash will be identified on the website and can change from time to time at BLOXDUEL’s sole and absolute discretion.
7.2.2. Cryptocurrency: When you redeem for cryptocurrency, the crypto payment will be made to the same wallet and in the same cryptocurrency that was used to purchase Fun Cash, or if this is not technically possible, then to a different wallet that you nominate, provided that the wallet is legally and beneficially owned by you. We reserve the right to require the same wallet and the same type of cryptocurrency for redemption as was used to purchase Fun Cash, even though Sweeps Cash played in Promotional Mode results in Prizes of value. At our discretion, we may specify a different payment method.
When you choose to redeem Sweeps Cash for cryptocurrency, it is your sole responsibility to ensure that the crypto wallet to which you are transferring funds can receive those funds. BLOXDUEL has no obligation to check or verify whether your wallet will accept the cryptocurrency that you select or nominate.
Sweeps Cash will be redeemable at an implied rate of 2 Sweeps Cash per 1 USD. As such, the amount of cryptocurrency that can be redeemed for 1 Sweeps Cash will be determined by the market price of that cryptocurrency in USD at the time of such redemption. This determination is made in our sole and absolute discretion.
7.3. In Florida and New York, the maximum redemption value of Sweeps Cash won on any Game is limited to USD $5,000 USD. Any redemption of a Prize in excess of USD $5,000 USD will be reduced to the maximum value of USD $5,000.
7.4. BLOXDUEL reserves the right to charge fees for processing the redemption of Prizes to you and to set a minimum redemption threshold for prize redemptions.
7.5 We will not make payments into an account or wallet which does not match your verified name or the name you provided when registering your account, or that is not legally and beneficially owned by you.
7.6. Timing and Frequency of Prize Redemptions
7.6.1. Due to factors out of BLOXDUEL’s control some redemptions may experience delays. If you have any concerns or questions about your redemption, please contact our support team. We do not accept any liability to you as a result of any delay, including those arising from any verification process.
7.6.2. We endeavor to process your redemption requests as soon as practicable.
7.6.3. Redemption requests are processed in the order in which they are received.
7.6.4. We reserve the right to process only one redemption request per account in any 24 hour period.
7.6.5. Without limiting the rights under this section, users can request to redeem Prizes of any value. However, we reserve the right to allocate or pay Prizes in smaller increments over a number of days until all of the Prize has been allocated or paid.
7.6.6. Regardless of redemption type, where you are required to provide the details of your financial institution, bank account, or wallet, you agree that you are solely responsible for the accuracy of those details. You further agree that where the details you have provided are not accurate, and we have processed the payment using the details provided, the redemption of that Prize is complete and we cannot and are not required to reverse or reissue the payment.
7.6.7. You acknowledge and agree that if your financial institution, account, or wallet does not meet the requirements of these Terms:
You will be required to nominate an alternative account or wallet for your redemption;
There will be delays; and
If you are unable to nominate an appropriate account or wallet meeting the requirements set out in these Terms within 60 days of a request to do so, we are not obligated to pay out the redemption and may, in our discretion, deem the Prize void.
7.6.8. If we mistakenly credit your account with Prizes that do not belong to you, whether due to technical error, human error, or otherwise, the amount credited will remain BLOXDUEL’s property and will be deducted from your account. If you have been transferred cryptocurrency that does not belong to you prior to us becoming aware of the error, the mistakenly paid amount will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to us. In the event of an incorrect crediting, you are obliged to notify Customer Support at [email protected].

any request you have made for redemption of Prizes will remain pending; and
we are entitled to restrict your Account in any manner that we may reasonably deem appropriate, including by suspending or deactivating your Account.
8.1.3. Where any identification, credit or other verification check we require cannot be completed to our satisfaction because you have not provided any document we request from you in the form that we require within 30 days’ of the date the document was first requested, then we are under no obligation to continue with the verification check and we may, in our sole discretion, deactivate or otherwise restrict your Account in any manner that we may reasonably deem appropriate.

19.2. BLOXDUEL does not provide advice regarding tax and/or legal matters. Customers who wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors.
20. Dispute Resolution and Agreement to Arbitrate
20.1. PLEASE READ THIS CLAUSE 20 CAREFULLY AS IT REQUIRES YOU TO ARBITRATE DISPUTES AGAINST BLOXDUEL ON AN INDIVIDUAL BASIS AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM BLOXDUEL.
20.2. By agreeing to these Terms and Conditions, you agree that any and all past, present and future disputes, claims or causes of action between you and BLOXDUEL or any of its affiliates, subsidiaries, ultimate parent and parent companies, partners, officers, directors, employees, contractors, shareholders, agents, licensors, subcontractors or suppliers, which arise out of or are related in any way to these Terms and Conditions, the formation of these Terms and Conditions, the validity or scope of this clause 20 (Dispute Resolution and Agreement to Arbitrate), your Participation in or other access to or use of the Games or the Website, or any other dispute between you and BLOXDUEL or any of its affiliates, subsidiaries, ultimate parent and parent companies, partners, officers, directors, employees, contractors, shareholders, agents, licensors, subcontractors or suppliers, including as to the arbitrability of any of the foregoing, and whether arising prior to or after your agreement to this clause 20 (Dispute Resolution and Agreement to Arbitrate) (all of the foregoing, collectively “Disputes”), will be governed by the procedure set out below. You and BLOXDUEL further agree that any arbitration pursuant to this clause 20 shall not proceed as a class, group or representative action.
20.3. Whether to agree to arbitration is an important decision. It is your decision to make and you ARE NOT REQUIRED TO rely solely on the information provided in these Terms and Conditions. You should take reasonable steps to conduct further research and, if you wish, to consult with counsel of your choice.
20.4. Informal Complaint Resolution
20.4.1. We want to address any concerns or Disputes you may have without the need for formal dispute resolution. Therefore, before filing any arbitration demand or other claim of any kind against BLOXDUEL or any of its affiliates, subsidiaries, ultimate parent and parent companies, partners, officers, directors, employees, contractors, shareholders, agents, licensors, subcontractors or suppliers, you agree to notify us in writing of the nature of your concern and/or Dispute and to try in good faith using best efforts to resolve it in accordance with clause 16. If your concern or Dispute is not resolved after exhausting the internal complaints process outlined in clause 16, only then may you initiate an arbitration as set out in this clause 20. At that time, BLOXDUEL may also initiate an arbitration. During the arbitration, the amount of any settlement offer made by you or BLOXDUEL shall not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.
20.5. Arbitration
20.5.1. We Both Agree to Arbitrate. If you reside in or access the Games at any time while located in the United States, this clause 20 (Dispute Resolution and Agreement to Arbitrate on an Individual Basis) shall be construed under and be subject to the Federal Arbitration Act, notwithstanding any other choice of law set out in these Terms and Conditions. By agreeing to these Terms and Conditions, both you and BLOXDUEL agree that any and all past, present and future Disputes, including without limitation any question regarding the existence, validity, enforceability, severability, or termination of these Terms and Conditions and/or this clause 20 (Dispute Resolution and Agreement to Arbitrate), shall be referred to and finally resolved by arbitration administered by JAMS. You further agree that all such Disputes between you and BLOXDUEL include those between you and any of BLOXDUEL’s licensors, distributors, suppliers, or agents, and whether arising prior to or after your agreement to this clause 20. JAMS will administer the arbitration under its Streamlined Rules in effect at the time arbitration is sought. Those rules are available at www.jamsadr.com. Arbitration will proceed on an individual basis and will be handled by a sole arbitrator in accordance with those rules; provided that the parties shall be presented with a list of five potential arbitrators and shall rank those potential arbitrators in order of preference. JAMS will select the arbitrator with the highest combined preference (e.g., if both parties select a potential arbitrator as their top preference, that arbitrator will be selected). The JAMS rules will govern payment of all arbitration fees. The arbitrator shall be authorized to award any remedies, including injunctive relief, that would be available to you in an individual lawsuit and that are not waivable under applicable law. In agreeing to this binding commitment to arbitrate your Disputes, you agree that you waive any right to proceed in a court of law or to have your claims heard by a jury. The arbitration shall, unless and only to the extent prohibited under JAMS rules: (1) be conducted by a single, neutral arbitrator in the English language; (2) be held virtually and not in person for all proceedings related to the arbitration, except by mutual agreement of all parties; and (3) be limited to one deposition per party, except by mutual agreement of all parties. Furthermore, in cases where neither party’s claim(s) or counterclaim(s) exceed $25,000, both parties agree to waive an arbitration hearing and resolve the dispute solely through submissions of documents to the arbitrator.
20.5.2. Notwithstanding any language to the contrary in this clause 20, if a party seeks a monetary award in excess of USD $500,000 or seeks an equitable form of relief that would significantly impact other Website users, in each case as reasonably determined by either party, the parties agree that such arbitration will proceed on an individual basis but will be handled by a panel of three arbitrators and take place pursuant to JAMS Comprehensive Arbitration Rules and Procedures. Each party shall select one neutral arbitrator, with the third neutral arbitrator selected in accordance with JAMS Comprehensive Rules. That third arbitrator shall serve as chair of the arbitral panel and must be a retired judge with experience arbitrating or mediating disputes. In the event of disagreement as to whether the threshold for a three arbitrator panel has been met, the sole arbitrator appointed in accordance with this clause shall make that determination. If the arbitrator determines that a three person panel is appropriate, the arbitrator may—if selected by either party or through the JAMS selection process—participate in the arbitral panel. You and BLOXDUEL agree that any award issued by a three arbitrator panel may be appealed in accordance with the JAMS Optional Arbitration Appeal Procedures at either party’s election.
20.5.3. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. All documents and information disclosed in the course of the arbitration shall be kept strictly confidential by the recipient and shall not be used by the recipient for any purpose other than for purposes of the arbitration or the enforcement of the arbitrator’s decision and award and shall not be disclosed except in confidence to persons who have a need to know for such purposes or as required by applicable law.
20.5.4. Both you and BLOXDUEL agree not to make any argument that JAMS is an inconvenient forum or otherwise incompetent or without authority or jurisdiction to hear any Dispute, and expressly waive any and all such arguments.
20.6. Arbitration to Proceed Individually
20.6.1. You and BLOXDUEL agree that an arbitration or any other proceeding to resolve a Dispute shall proceed in an individual capacity only, and neither you nor BLOXDUEL may bring a Dispute as a Collective Action. UNLESS BOTH YOU AND BLOXDUEL AGREE, NO ARBITRATOR OR JUDGE MAY CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR ENGAGE IN ANY COLLECTIVE ACTION. The Batch Arbitration Provision is the only exception.
20.6.2. Without limiting the generality of clause 20.7.1 or the term Collective Action, and as an example only, a claim to resolve a Dispute against BLOXDUEL will be deemed a Collective Action if:
• claims are filed or pursued concurrently by or on behalf of two or more persons; and
• counsel for the two or more persons is the same, or share fees, or coordinate in any way.
20.6.3. For the purposes of this clause, the term ‘concurrently’ means that the claims are pending (filed but not resolved) at the same time.
20.7. Waiver of Collective Action
20.7.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER YOU NOR BLOXDUEL WILL BE ENTITLED TO PARTICIPATE IN ANY COLLECTIVE ACTION (AS DEFINED ABOVE), OR OTHERWISE CONSOLIDATE, JOIN, PARTICIPATE, REPRESENT OR COORDINATE DISPUTES (AS DEFINED ABOVE) WITH OR INVOLVING OTHER INDIVIDUALS OR ENTITIES, INCLUDING AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY IN CONNECTION WITH ANY DISPUTE (AS DEFINED ABOVE), OR OTHERWISE SEEK TO RECOVER LOSSES OR DAMAGES (WHETHER FOR YOURSELF OR OTHERS) INCURRED BY A THIRD PARTY. ALL SUCH RIGHTS ARE EXPRESSLY AND UNCONDITIONALLY WAIVED. THE PARTIES FURTHER AGREE THAT THE JAMS RULES REFERENCED ABOVE SHALL EXCLUDE ANY RULES OR PROCEDURES GOVERNING OR PERMITTING COLLECTIVE ACTIONS (AS DEFINED ABOVE) OF ANY KIND.
20.7.2. To increase efficiency of resolution, in the event 25 or more similar arbitration demands against BLOXDUEL or its licensor’s, distributors, suppliers or agents is presented by or with the assistance of the same law firm or organization or group of law firms or organizations working in coordination, are submitted to JAMS, the JAMS Mass Arbitration Procedures and Guidelines shall apply. In such event, the JAMS Process Administrator (as described in the JAMS Mass Rules) shall have the authority to implement the procedures set forth in the JAMS Mass Rules, including the authority to batch together individual arbitration demands into a single coordinated proceeding. All provisions of this clause 20 that are not in conflict with the JAMS Mass Rules, including the qualifications of arbitrators, shall continue to apply.
20.7.3. BY AGREEING TO THESE TERMS, YOU ACKNOWLEDGE THAT YOU AND BLOXDUEL EACH WAIVE THE RIGHT TO: (1) A JURY TRIAL; AND (2) PARTICIPATE IN A CLASS ACTION. IF A COURT DECIDES THAT APPLICABLE LAW PRECLUDES ENFORCEMENT OF ANY OF THIS PARAGRAPH’S LIMITATIONS AS TO A PARTICULAR CLAIM FOR RELIEF, THEN THAT CLAIM (AND ONLY THAT CLAIM) MUST BE SEVERED FROM THE ARBITRATION AND MAY BE BROUGHT IN COURT.
20.7.4. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS AND CONDITIONS, IN THE EVENT ALL OR ANY PORTION OF THIS CLAUSE 20 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE) IS FOUND TO BE INVALID OR LESS THAN FULLY ENFORCEABLE, THEN THE ENTIRETY OF CLAUSE 20 (EXCEPT THIS SENTENCE AND THOSE PROVISIONS APPLICABLE TO LITIGATION) MAY, UPON BLOXDUEL’S SOLE AND EXCLUSIVE ELECTION, BE DEEMED VOID AND AS HAVING NO EFFECT, SUBJECT TO BLOXDUEL’S RIGHT TO APPEAL THE LIMITATION OR INVALIDATION OF SUCH CLAUSE.
20.8. You have the right to opt-out and not be bound by the arbitration and class action waiver provisions of this clause 20 (Dispute Resolution and Agreement to Arbitrate) by sending written notice of your decision to opt out from the email address registered on your Account to [email protected]. The notice must be sent within 30 days of creation of your Account, otherwise you shall be bound to arbitrate disputes in accordance with these Terms. If you opt-out of these arbitration provisions, BLOXDUEL will also not be bound by them. If you do not opt out of this clause 20 (Dispute Resolution and Agreement to Arbitrate) within the specified time period, you will be deemed to have accepted the arbitration and class action waiver provisions.
20.9. Subject to clause 20 (Dispute Resolution and Agreement to Arbitrate on an Individual Basis), either you or we may bring an action in a court as authorized by clause 22.
20.10. Survival of Obligations
20.10.1. THIS CLAUSE 20 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE) SURVIVES THE TERMINATION OF THESE TERMS AND CONDITIONS FOR ANY REASON.
